Code of Ethics CPRE™
While the Academy of Probate Code of Ethics establishes standards and obligations that may be higher than the law, in any instance where the code of ethics and the law conflict, the obligations of the law must take precedence.
The Certified Probate Real Estate Expert shall:
Be an Active Real Estate Agent/ Salesperson
Have no disciplinary actions against their real estate license
Must be in Good Standing
Real Estate License must be in Good Standing at all times
Maintain clients confidentiality and be the fiduciary in the transaction
Put the family’s interests a top #1 priority in the transaction
Must Not take sides with the family member’s, yet serve as a neutral party to each family member, heir, interested party etc.. in the transaction
Be respectful and courteous to other CPRE’s
Always refer clients to an attorney if client’s questions or concerns are out of the scope of a Real Estate Salesperson
Not receive nor give referral fees, or “kickbacks” for attorney referrals
Always get the client’s written consent before discussing or providing any confidential information with a party who is not the authorized representative of the transaction.
Not take a listing out of one's scope of expertise
In addition, Adhere to the Real Estate Salesperson code of ethics set forth by each jurisdiction and state that the real estate license is held in
